October 18, 2018 Marcus Kubes Management Group (“MKM”) is proud to announce the launch of Canada’s first full-service law firm and management agency dedicated to esports and content creators.

With the video game industry exceeding $100 billion in global revenue and $3.7 billion of that contributing to Canada’s overall GDP, it’s no surprise that sponsors, organizations and investors alike are turning their attention toward the world of esports. Esports is growing at an unprecedented pace with some tournament prizes in the multi-millions. Once such tournament,The International, was held this past August in Vancouver Canada and had a total prize-purse of $25 million dollars – with the winning team taking home $11 million.

While those in the industry often regard it as the “fifth major sport,” the infrastructure necessary to facilitate and stabilize its growth is not keeping pace with likes of traditional sports. This creates the potential for regulatory mishaps, power imbalances and legal grey areas.

“The esports industry is accelerating at an unprecedented pace. Casual gamers, many of whom are teenagers, can turn into celebrities overnight and find themselves with sponsorships and employment contracts, without a full appreciation of what they’ve signed up for” says Josh Marcus, MKM Managing Partner. “We’ve founded MKM to provide clarity and help its clients navigate the complex business and legal landscape inherent in the esports ecosystem.”

Given the rise of social media outlets including Instagram, YouTube, and Twitch, the reach and economic opportunity for gamers and content creators has never been greater. But with few regulations and no safeguards protecting their rights and interests, there has been a remarkable rise in legal issues involving intellectual property and contract disputes.

Nevertheless, esports continues to secure its place in mainstream society with some parents even hiring tutors to help their children hone their skills in popular games such as Fortnite.

“The appeal lies in accessibility”, says Evan Kubes, MKM President. “You no longer need to be over 6 feet and have 250lbs of muscle to be professional athlete. With a competitive drive and a cell phone, anyone could conceivably become a professional esports star.”

MKM is a full-service law firm located in Toronto, ON which deals with contracts, immigration, M&A, intellectual property, franchising, and assisting non-endemic sponsors, individuals and organizations enter the esports space. On the agency side, MKM has a particular focus on developing client’s brands through sponsorship acquisition, creative consulting, marketing and social media.
